1. Information about us
1.1 This website is owned and operated by The Teaspoon Club. Address for correspondence is 55 Belmont Road, Ironbridge, Shropshire, TF8 7QT.
2. The contract between us
2.1 After placing an order you will receive an email recognising that we have received your order. Once we accept, your order brings into existence a legally binding contract that governs both of us. The contract exists only for the products we have confirmed in the order confirmation.
3. Availability and Delivery
3.1 All orders are subject to acceptance and availability. If we have no stock available for your order or part of your order, we will contact you through our email, firstname.lastname@example.org.
3.2 A projected dispatch date will be confirmed in your order confirmation email. This can vary based on stock levels, your delivery address and the time and date of your order. Standard delivery will take approximately 3-5 working days after placing your order
3.3 We only deliver orders within the UK including Northern Ireland.
3.4 We are not liable to replace or refund any orders that have been delivered to the wrong address.
4. Price and Payment
4.1 The prices payable for goods you order are as set out on our website. All prices include VAT at the current rate.
4.2 Product prices are liable to change at any time, but changes will not affect orders that we have already recognised (sent a confirmation email).
5. Risk and ownership
5.1 Risk of damage to or loss of the products and ownership will transfer to you at the time of which we dispatch your goods.
5.2 The goods we supply to you are strictly not for resale.
5.3 None of our goods are intended for consumers with allergies and we will accept no responsibility for customers who chose to ignore this
6.1 If you are unsatisfied with your goods for a genuine reason such as: missing products or contents damaged, we will offer you a complete refund as long as it can be shown that the products supplied to you are not provided as they are supposed to be.
6.2 Customers may request a refund within 30 days of purchase by returning the unopened goods to us in its original state.
6.3 Customers are liable for return postage for refunds.
7. Cancellation by us
7.1 We reserve the right to withdraw the contract between us and reject your order if:
7.1.1 we have insufficient stock to deliver the products you have ordered;
7.1.2 we do not deliver to your address location;
7 1.3 one or more of the products you ordered was listed on our website at the wrong price due to a typographical error or an error in the pricing information received by us from our suppliers; or
7.1.4 we believe that you have broken our terms and conditions;
7.2 If we do reject your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card in relation to this particular rejected order as soon as possible but in any event within 30 days of your order.
8.1 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you inform us via our email, email@example.com, within 60 days of the date on which you ordered the products (unless this is not reasonably possible). If you inform us of a problem under these conditions, our only obligation will be, at your option, either:
8.1.1 to make good any shortage or non-delivery;
8.1.2 to replace any goods damaged; or
8.1.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.
8.2 Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
8.3 You must observe and obey all applicable regulations and legislation, including obtaining all required customs, import or other licences to buy products from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
8.4 Nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights, nor to limit our liability to you for any death or personal injury resulting caused by our negligence.
9.1 Unless otherwise explicitly stated in our terms and conditions, all notices from you to us must be sent via email to firstname.lastname@example.org.
9.2 All general notices from us to you will be displayed on our website.
10. Changes to legal notices
10.1 We reserve the right to alter these terms and conditions and you should look through them as frequently as possible.
11. Law, jurisdiction and language
11.1 This website, any content on it and any contract brought into existence as an outcome of the usage of this website are governed by and construed in harmony with English law. Parties to any contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
12.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
14. Third party rights
14.1 Nothing in this Agreement is meant to, nor shall it, confer any rights on to a third party.
15. Ownership of rights
15.1 All rights, including copyright, in this website are owned by or licensed to The Teaspoon Club (theteaspoonclub.co.uk). Any use of this website or its contents, including copying or storing it or them in entire or part, other than for your own personal, non commercial use, is forbidden without our consent. You may not alter, distribute or repost anything on our website for any purpose.
